It is important to note that Terms and Conditions of service is a legal agreement between you and BlackMatrimony.com. By clicking on the “I agree” check box, you agree to be bound by the terms and conditions of this agreement. Please note that this agreement is subject to change at any time at the discretion of BlackMatrimony.com. If you do not agree to the Terms and Agreement we ask that you do not sign up for this service. This agreement is void where prohibited.

1. Individuals below 18 years of age may not sign up to the service. 2. Individuals that are already married may not sign up to the service. By using this service, you both represent and warrant that you are not married.

Exclusive Use & Accountability

1. Your account is for your sole, personal use, you may not authorize others to use your account, and you may not assign or otherwise transfer your account to any other person or entity. Also note that you are solely responsible for the content or information you publish, display or otherwise communicate in any manner (hereinafter, "post") on the service, or transmit to other Members.

Conduct

1. We at BlackMatrimony.com expect that you conduct yourself in a manner that is considerate and respectful of yourself as well as to others. As a Member of this service, you agree that you will not post, send or communicate or transmit to other Members, any defamatory, offensive, graphic, sexually oriented and/or explicit, threatening, offensive, or illegal material, or any material that infringes or violates another party's rights (including, but not limited to, intellectual property rights, and rights of privacy and publicity).

Use of the BlackMatrimony.com Service

1. You will use the BlackMatrimony.com service in a manner consistent with any and all applicable local, state, national and international laws and regulations, including, but not limited to, United States export control laws.

2. You will not provide inaccurate, misleading or false information to BlackMatrimonial.com or other Members. If information provided to BlackMatrimony.com, or another Members, subsequently becomes inaccurate, misleading or false, you will promptly notify BlackMatrimony.com of the change.

3. You will not engage in advertising to, or solicitation of, registered users of BlackMatrimony.com or sell products or services to other users as a user of the service. In addition you will not sell products and/or services through the Service or transmit any chain letters or junk E-mail to other registered users.

4. You will not post, copy, modify, transmit, show in public or private, create any derivative works from, distribute or reproduce in any way any copyrighted material, trademarks, or other proprietary information without obtaining the prior consent of the owner of such proprietary rights.

5. Posting of illegal or prohibited material on the site is strictly prohibited. BlackMatrimony.com reserves the right to investigate and take appropriate legal action in its sole discretion against anyone who violates this provision, including without limitation, removing the offending posting from the site and terminating the membership of such violators. You as a member, will promptly report to the Company any violation of the Terms of this Agreement by other Members.

Relationship Disclaimer

1. With the exception of Premium Memership, you understand that BlackMatrimony.com does not guarantee that you will find friendship, a long term relationship and or marriage with individuals you meet through the site and/or service.

Site Content and Other Materials

1. BlackMatrimony.com reserves the right, but has no obligation, to monitor the materials posted in the public areas of the service. BlackMatrimony.com shall have the right to remove any such material that in its sole opinion violates, or is alleged to violate, any applicable law or either the letter or spirit of this Agreement. Notwithstanding this right of the Company, you remain solely responsible for the content of the materials you post in the public area of the service and in your private email messages. E-mail correspondence between you and other Members that are not readily accessible to the general public will be treated as private by the Company to the extent permitted by applicable law.

2. Online content consisting of advice and opinions posted on BlackMatrimony.com are those of their respective authors, and should not necessarily be relied upon. BlackMatrimony.com does not guarantee, endorse, adopt or accept responsibility for material posted on the site by respective authors and/or registered users. In no event shall BlackMatrimony.com be held liable for any damages whatsoever, whether they be direct, indirect, general, special, consequential and/or incidental.

You expressly understand and agree that BlackMatrimony.com and our affiliates shall not be liable for any direct, indirect, incidental, special, consequential, exemplary or punitive damages, or any other damages whatsoever, including but not limited to, damages for loss of profits, goodwill, use, data or other intangible losses (even if we have been advised of the possibility of such damages), arising out of, or resulting from or relating to the conduct you or anyone else in connection with the use of the service including but not limited to bodily injury, emotional distress, harm and/or any other damages resulting from communications or meetings with other registered users of this service or persons introduced to you by this service.

Indemnity

You agree to indemnify and hold BlackMatrimony.com, affiliates, officers, agents, and other partners and employees, harmless from any loss, liability, claim, or demand, including reasonable attorney's fees, made by any third party due to or arising out of your use of the Service in violation of this Agreement and/or arising from a breach of these Terms & Conditions and/or any breach of your representations and warranties set forth above.

Termination

1. Either you or the BlackMatrimony.com may terminate your account at any time, for any reason or no reason, without explanation, effective upon sending written notice to the other party. BlackMatrimony.com reserves the right to immediately suspend or terminate your access to The Service, without notice, upon any breach of this Agreement by you which is brought to the Company's attention. In the event your access to The Service is suspended due to the breach of this Agreement, you agree that all fees then paid to the Company by you shall be non refundable.

General Provisions

You agree that New Jersey law (regardless of conflicts of law principles) shall govern this Agreement, and that any dispute arising out of or relating to this Agreement shall be subject to the exclusive jurisdiction of the federal and state courts in the District of New Jersey, other than for actions to enforce any order or judgment entered by such courts.

This Agreement, accepted upon registration for The Service, contains the entire agreement between you and the Company regarding the use of this Service. Unless otherwise explicitly stated, the terms will survive termination of your registration to the Service. If any provision of this Agreement is held invalid, the remainder of this Agreement shall continue in full force and effect. You, the buyer, may cancel this agreement, without any penalty or obligation at any time. To cancel this agreement, mail or deliver a signed and dated notice, or send a telegram which states that you, the buyer, are canceling this agreement, or words to similar effect.
